If you do not agree to these Terms, please do not use this website. Santillan Jewelers is domiciled in and maintains its principal place of business in the State of California.

Acceptance of Terms

BY ACCESSING THIS WEBSITE, SUBMITTING A CONTACT FORM, ENTERING OUR STORE, PURCHASING ANY PRODUCT, OR USING ANY SERVICE PROVIDED BY SANTILLAN JEWELERS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE AND OUR PRIVACY POLICY. These Terms apply to all visitors, customers, and any person who accesses our website or engages in any transaction or service with Santillan Jewelers, whether online or in-store. If you do not agree to these Terms, you must discontinue use of this website and our services immediately.

These Terms constitute a legally binding agreement between you and Santillan Jewelers. We reserve the right to refuse service to anyone who does not agree to or comply with these Terms.

1. Use of This Website

This website is provided for informational purposes about Santillan Jewelers' products and services. You are granted a limited, non-exclusive, revocable license to access and use this website for personal, non-commercial purposes. You agree not to:

We strive to provide accurate descriptions of our products and services. However, we do not warrant that product descriptions, pricing, photographs, or other content on this website are accurate, complete, or current. Images are for illustrative purposes and may not exactly represent the actual product. All products and services are subject to availability.

Gemstones and precious metals are natural materials. Variations in color, clarity, cut, and appearance are inherent characteristics of natural stones and are not considered defects. Photographs on this website may not capture the full detail, scale, or exact color of a piece due to differences in screen displays, lighting, and photography. Precious metal and gemstone prices are subject to market fluctuation; quoted prices are valid only at the time they are provided.

4. Custom Design Policy

Custom-designed jewelry is created specifically for the individual customer. By approving a custom design for production, you acknowledge and agree to the following:

• All custom design deposits are non-refundable once design work has commenced
• Custom pieces are considered final sale and cannot be returned, exchanged, or refunded once production has begun
• Your written or verbal approval of a design, CAD rendering, or wax model constitutes acceptance of the design and authorization to proceed with production
• Minor variations between approved designs, renderings, or models and the finished piece may occur due to the handcrafted nature of jewelry production and the natural characteristics of gemstones and metals
• Estimated completion timelines are provided in good faith but are not guaranteed; delays may occur due to material sourcing, complexity of design, or other factors beyond our control
• Santillan Jewelers retains the right to photograph completed custom pieces for portfolio and marketing purposes unless you request otherwise in writing prior to production

5. Returns, Exchanges, and Refunds

Return and exchange eligibility varies by product type. The following general policies apply:

• Non-custom jewelry may be eligible for return or exchange within a specified period, subject to our in-store return policy in effect at the time of purchase
• Items must be returned in their original, unworn condition with all original packaging, certificates, and documentation
• Custom-designed and special-order pieces are final sale and are not eligible for return, exchange, or refund
• Engraved, sized-to-order, or altered pieces may not be eligible for return
• Proof of purchase is required for all returns and exchanges

Specific return policy details are provided at the time of purchase. Please ask a team member for the current policy before completing your transaction.

6. Repair and Service Liability

When you leave jewelry or other items with Santillan Jewelers for repair, maintenance, appraisal, or any other service, you acknowledge and agree to the following:

• While we take every reasonable precaution to safeguard your items, Santillan Jewelers' liability for loss, theft, or damage to items left in our care shall not exceed the appraised or replacement value of the item, as determined by Santillan Jewelers in its reasonable professional judgment
• You are responsible for disclosing any known defects, damage, prior repairs, treatments, or enhancements to your item at the time of drop-off; failure to disclose may limit our liability
• Certain repairs carry inherent risks (e.g., stone setting, soldering near heat-sensitive stones, antique or fragile pieces); we will communicate known risks before proceeding, but unforeseen damage may occur
• Off-Site Work: While most work is performed in-house at our Roseville location, certain repairs, custom fabrication, stone setting, or specialized services may require your item to be transported to our jeweler's off-site workshop or to a third-party specialist. By leaving your item with Santillan Jewelers for service, you consent to such transportation when necessary. We take reasonable precautions during transport, including insurance coverage where applicable, but you acknowledge that transportation of your item is at your own risk to the extent permitted by law
• Repair estimates are provided in good faith; actual costs may vary if additional work is discovered to be necessary, in which case we will contact you for approval before proceeding

Abandoned Property

Items left for service for more than ninety (90) days after notification of completion, whether by phone, email, or text message to the contact information you provided, without response or pickup by the customer, will be deemed abandoned property. Santillan Jewelers will make at least two (2) documented attempts to contact you before declaring an item abandoned. After the 90-day period, Santillan Jewelers may dispose of, sell, or otherwise handle the abandoned item in accordance with California Civil Code Section 1899 et seq. and other applicable California law. Santillan Jewelers shall not be liable for any loss, damage, or diminution in value of abandoned items. Any proceeds from the sale of abandoned property, after deducting unpaid service charges and storage costs, will be handled in accordance with applicable law.

7. Appraisal Disclaimer

Jewelry appraisals provided by Santillan Jewelers represent the professional opinion of the appraiser at the time the appraisal is conducted. Appraisals are not guarantees of value, offers to purchase, or representations of resale value. Market conditions, demand, and other factors can cause the actual value of jewelry to differ from an appraised value. Appraisal values may change over time and should be updated periodically. Santillan Jewelers shall not be liable for any financial loss or gain resulting from reliance on an appraisal.

8. Insurance Recommendation

Santillan Jewelers strongly recommends that you obtain appropriate insurance coverage for all fine jewelry purchases. Once an item leaves our premises, we are not responsible for loss, theft, or damage. We can provide appraisals and documentation to assist with obtaining insurance coverage. Failure to insure your jewelry is at your own risk.

9. Financing

Financing options may be available through third-party financing providers. Any financing arrangement is a separate agreement between you and the financing provider, and is subject to the financing provider's own terms, conditions, and credit approval process. Santillan Jewelers is not a party to any financing agreement and makes no representations or warranties regarding financing terms, approval, or availability.

10. Contact Form and Communications

When you submit information through our contact form, you agree that the information you provide is accurate and truthful. We will use your information solely as described in our Privacy Policy. Submitting a contact form does not create a binding contract or obligation on either party. By providing your phone number, you consent to receiving calls or text messages from Santillan Jewelers related to your inquiry. Standard messaging rates may apply. You may opt out of communications at any time by contacting us.

WITH RESPECT TO JEWELRY PRODUCTS AND SERVICES, ANY WARRANTIES ARE LIMITED TO THOSE EXPRESSLY PROVIDED IN WRITING AT THE TIME OF PURCHASE OR SERVICE. SANTILLAN JEWELERS DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SANTILLAN JEWELERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THIS WEBSITE, THE PURCHASE OF ANY PRODUCT, OR THE USE OF ANY SERVICE.

14. Indemnification

You agree to indemnify, defend, and hold harmless Santillan Jewelers, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way related to your use of this website, the purchase or use of any product, or your violation of these Terms.

15. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Any dispute, controversy, or claim arising out of or relating to these Terms, this website, any product purchased from Santillan Jewelers, or any service provided by Santillan Jewelers, including but not limited to claims related to custom design, repair, appraisal, or any other transaction, shall be resolved exclusively through final and binding arbitration, rather than in court.

Exclusive Venue

All arbitration proceedings shall take place in Placer County, California, which is the county in which Santillan Jewelers maintains its principal place of business. You irrevocably consent to personal jurisdiction and exclusive venue in Placer County, California for the purposes of any arbitration or, if applicable, any court proceeding arising under these Terms. This choice of venue shall apply regardless of where you reside or where the transaction occurred.

Arbitration Rules and Procedure

The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted before a single neutral arbitrator selected in accordance with AAA procedures. The arbitrator shall apply California substantive law. The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction.

Costs, Fees, and Attorney's Fees

The party initiating the arbitration shall be responsible for paying all arbitration filing fees and initial administrative costs. The prevailing party in any arbitration or legal proceeding arising under these Terms shall be entitled to recover its reasonable attorney's fees, costs, and expenses (including expert witness fees, arbitrator fees, and all other costs of arbitration) from the non-prevailing party. For the purposes of this provision, "prevailing party" means the party that substantially obtains the relief sought, whether by settlement, judgment, or arbitration award.

Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Santillan Jewelers. If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason, then the arbitration agreement shall be deemed null and void with respect to such claim, and the dispute must be brought exclusively in state or federal courts located in Placer County, California.

Jury Trial Waiver

IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN IN ARBITRATION, YOU AND SANTILLAN JEWELERS EACH UNCONDITIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY.

Statute of Limitations

Any claim arising under these Terms or related to any product or service must be brought within one (1) year after the cause of action arises, or it shall be permanently barred. This provision shall apply to the fullest extent permitted by applicable law.

16. Governing Law and Exclusive Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. To the extent any dispute is not subject to arbitration as set forth above, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Placer County, California. You irrevocably submit to the personal jurisdiction of such courts and waive any objection to venue, including any objection based on forum non conveniens.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this website with an updated effective date. Your continued use of this website after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Santillan Jewelers regarding your use of this website and supersede any prior agreements or understandings.
